Terms and Conditions of Sale

Article 1 — Purpose and Scope

These General Terms and Conditions of Sale (“Terms”) govern all contractual relationships between NAOF EYEWEAR SASU operating the Eyewearista store (hereinafter “the Seller”) and any adult individual, non-merchant, making a purchase on the website eyewearista.com (hereinafter “the Customer”).

Any order implies unreserved acceptance of these Terms.

Article 2 — Products

Eyewearista offers sunglasses and optical frames from luxury brands (Celine, Cartier, Chopard, Chloé, Dior, Fred, Gucci, Linda Farrow, Matsuda, Tom Ford, Bottega Veneta, Saint Laurent, Boucheron, and more).

Product photographs are non-contractual. The Seller makes every effort to present products as accurately as possible, but slight differences in rendering (color, tone, light effects) may exist between the on-screen image and the physical product.

Sale of corrective lenses: In accordance with applicable regulations (Article L.4362-9 of the French Public Health Code), the sale of corrective lenses requires the presentation of a valid prescription. The Customer agrees to provide this prescription to the Seller according to the procedures indicated at the time of order.

Article 3 — Orders

3.1. Process

The Customer places an order online by selecting the desired items, adding them to the cart, then validating the order after entering delivery and payment information.

3.2. Confirmation

The order is only considered accepted after:
1. Payment validation,
2. Sending of a confirmation email summarizing the order.

The Seller reserves the right to refuse an order in case of prior dispute, product unavailability, or any other legitimate reason.

Article 4 — Prices

Prices are indicated in euros, VAT included (French VAT at the applicable rate). They do not include shipping costs, which are charged separately according to the chosen method and delivery location.

The Seller reserves the right to modify prices at any time; however, products are invoiced on the basis of the rates in force at the time of order validation.

Article 5 — Payment

Accepted payment methods are:
Credit card (Visa, Mastercard, American Express) via WooCommerce Payments / Stripe

Payment is secured by SSL encryption. No banking data is retained by Eyewearista.

In case of fraudulent payment or bank rejection, the order is automatically canceled.

Article 6 — Delivery

6.1. Zones

Eyewearista delivers in Metropolitan France, the European Union, and internationally (133 countries).

6.2. Delivery methods

6.3. Delivery times

Indicative delivery times, from the date of dispatch:
– Metropolitan France: 72 hours (as per Eyewearista standard)

Eyewearista cannot be held responsible for delays attributable to the carrier or customs.

6.4. Receipt

Upon receipt, the Customer checks the condition of the package. In case of apparent damage, precise reservations must be noted on the delivery slip and Eyewearista must be contacted within 48 hours (contact@eyewearista.com).

Article 7 — Right of Withdrawal

In accordance with Articles L.221-18 and following of the French Consumer Code, the Customer has a 14-day period from receipt of the product to exercise their right of withdrawal, without having to justify their decision.

7.1. Procedure

To exercise this right, the Customer must notify their decision to the Seller by email at contact@eyewearista.com or by postal mail to the registered office. The standard withdrawal form (Appendix) may be used but is not mandatory.

7.2. Product return

The product must be returned:
– In its complete original packaging (case, pouch, cleaning cloth, brand box)
– With all accessories provided
– In new condition, unworn, undamaged
– Within 14 days following notification of withdrawal

Return costs are the responsibility of the Customer, unless otherwise indicated.

7.3. Refund

The refund is made within a maximum period of 14 days from receipt of the returned product, using the same payment method as the one used for the order, unless otherwise agreed.

The Seller may defer the refund until recovery of the product or until the Customer has provided proof of shipment, whichever is the earlier.

7.4. Exceptions

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply:
– To personalized products or products made to the Customer’s specifications (corrective lenses fitted to measure, engravings, etc.)
– To products unsealed after delivery for hygiene reasons

Article 8 — Warranties

All products benefit from:
Legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code) — 2 years from delivery
Warranty against hidden defects (Articles 1641 et seq. of the French Civil Code)
Manufacturer’s commercial warranty: variable according to the brand (generally 2 years) — [TO COMPLETE: specify if specific extended warranty]

In case of defect, the Customer contacts Eyewearista who organizes the handling (repair, replacement, refund).

Article 10 — Liability

Eyewearista’s liability cannot be engaged for any damage resulting from misuse of the product, customer negligence, or normal wear and tear.

Eyewearista cannot be held responsible for non-performance or improper performance of the contract attributable to a case of force majeure.

Article 11 — Personal Data Protection

The Customer’s personal data is processed in accordance with the Privacy Policy, accessible at any time on the site.

Article 12 — Dispute Resolution

12.1. Mediation

In accordance with Articles L.611-1 et seq. of the French Consumer Code, the Customer may resort free of charge to a consumer mediator in the event of an unresolved dispute:

12.2. European Platform

12.3. Competent Jurisdiction

In the absence of amicable agreement, any dispute will be submitted to the competent French courts.

Article 13 — Applicable Law

These Terms are governed by French law, regardless of the place of delivery and the nationality of the Customer.

Article 14 — Modification of the Terms

The Terms applicable to an order are those in force on the day of validation of the said order. Any subsequent modification shall not apply retroactively to orders already placed.
